Terms of Service

1. Definitions

For the purposes of these Terms of Service, the following terms have the following meanings:

• Service – the online platform available at seorise.ai, enabling the use of the AI content generator and other features.
• Provider – Address: ALLIT, Aleksandra Sochaczewskiego 4/81, 96-500 Sochaczew, Poland, NIP: 8371873962.
• User – a natural person, legal person, or organizational unit without legal personality using the Service.
• Account – a set of resources and permissions within the Service assigned to a specific User.
• Content – any text, graphic, audiovisual, or other materials generated by the Service or published by the User while using the Service.
• Subscription – paid access to certain features and services of the Service for a specified period.

2. Registration and Account Use

2.1. Registration Conditions

To use the full functionality of the Service, you must create an Account. Registration requires providing the necessary data and creating a password. The User is obliged to provide true and up-to-date data during registration and to update them in case of changes.

2.2. Account Security

The User is responsible for maintaining the confidentiality of their login data and for all activities undertaken using their Account. The User undertakes to immediately notify the Provider of any unauthorized use of their Account or other security breaches.

2.3. Age Restrictions

The Service may only be used by persons over 16 years of age. Persons under 18 may use the Service only with the consent of their parents or legal guardians.

3. Services and Subscriptions

3.1. Available Services

The Service offers the following services:

• AI content generator for creating articles, blog posts, and other texts
• SEO optimization tools
• Integrations with CMS systems
• API for developers
• Other features available within specific plans

3.2. Subscription Plans

The Service offers various subscription plans differing in functionality, content generation limits, and price. A detailed description of available plans can be found on the pricing page.

3.3. Payments and Billing

Payments for subscriptions are made in advance for the selected period. We accept credit card payments, bank transfers, and other payment methods indicated in the Service. If you choose automatic subscription renewal, the fee will be charged automatically before the start of the next billing period.

3.4. Refund Policy

The User has the right to withdraw from the contract within 14 days of its conclusion, without giving any reason. However, the right of withdrawal does not apply if the User has expressly agreed to the commencement of the service before the withdrawal period and has been informed of the loss of the right to withdraw.

3.5. Changes to Services and Prices

The Provider reserves the right to modify, add, or remove Service features, as well as to change subscription prices. Users will be notified of any changes in advance.

4. User Rights and Obligations

4.1. Permitted Use

The User may use the Service only for lawful purposes and in accordance with these Terms of Service. The User undertakes not to use the Service to:

• Generate content that is illegal, misleading, harmful, obscene, defamatory, or otherwise inappropriate
• Infringe copyrights, trademarks, or other intellectual property rights
• Engage in activities aimed at disrupting the operation of the Service or circumventing its security
• Collect or gather information about other Users
• Distribute viruses, malware, or other harmful code
• Engage in activities contrary to good morals or infringing the personal rights of third parties

4.2. Responsibility for Content

The User is fully responsible for the content generated using the Service and the way it is used. The Provider does not monitor, verify, or approve content generated by the User.

4.3. Reporting Violations

The User may report content that violates the law or these Terms of Service to: legal@seorise.ai. The report should include a precise indication of the disputed content and justification for the report.

5. Intellectual Property Rights

5.1. Service Ownership

All rights to the Service, including rights to its graphic elements, logo, layout, software, and databases, belong to the Provider or its licensors and are protected by copyright, industrial property law, and other intellectual property protection regulations.

5.2. License for the User

The Provider grants the User a non-exclusive, non-transferable license to use the Service to the extent necessary to use the offered services, in accordance with their intended purpose and these Terms of Service.

5.3. Rights to Generated Content

Subject to the limitations resulting from the law and these Terms of Service, the User receives full rights to content generated using the Service under the purchased subscription. However, the Provider does not transfer to the User any rights to the algorithms and technologies used to generate the content.

5.4. Content Provided by the User

The User retains all rights to content provided by themselves to the Service (e.g., keywords, descriptions, instructions). At the same time, the User grants the Provider a non-exclusive, free license to use this content for the purpose of providing services and improving the Service's algorithms.

6. Limitation of Liability

6.1. Service Availability

The Provider makes every effort to ensure the continuity of the Service, but does not guarantee its uninterrupted availability. The Provider reserves the right to temporarily suspend the availability of the Service for maintenance or updates.

6.2. Quality of Generated Content

The Provider does not guarantee that content generated by the Service will be free from errors, inaccuracies, or other imperfections. The Service uses artificial intelligence technology, which has its limitations. The User should always verify the generated content before using it.

6.3. Disclaimer

The Provider is not liable for:

• Damages resulting from improper use of the Service or unlawful actions of the User
• Damages resulting from the use of content generated by the User
• Loss of data or interruptions in the operation of the Service caused by circumstances beyond the Provider's control
• Content or services available through third-party links posted on the Service

6.4. Limitation of Compensation

To the extent permitted by applicable law, the total liability of the Provider to the User for any claims related to the use of the Service is limited to the amount actually paid by the User for the services in the 12 months preceding the claim.

7. Personal Data

The rules for processing Users' personal data are set out in the Privacy Policy, which forms an integral part of these Terms of Service.

8. Termination

8.1. Termination by the User

The User may delete their Account in the Service at any time, which is tantamount to terminating the contract. For paid subscriptions, termination takes effect at the end of the paid period, unless the terms of a specific offer state otherwise.

8.2. Termination by the Provider

The Provider has the right to block access to the Account or terminate the contract with immediate effect in the event of:

• Violation by the User of the provisions of these Terms of Service
• Providing false data during registration
• Using the Service contrary to its intended purpose or to the detriment of third parties
• Acting to the detriment of the Provider or other Users

8.3. Consequences of Termination

After termination, the User loses access to their Account and all data and content stored within the Service. The Provider may retain a copy of the User's data in accordance with the Privacy Policy and applicable law.

9. Changes to the Terms of Service

The Provider reserves the right to change these Terms of Service at any time. Changes take effect 14 days after their publication on the Service. Users will be notified of changes to the Terms of Service by email or a notice on the Service.

If the User does not accept the changes, they should stop using the Service and delete their Account before the changes take effect. Continued use of the Service after the changes are introduced constitutes acceptance of them.

10. Final Provisions

10.1. Governing Law

These Terms of Service are governed by Polish law and should be interpreted accordingly.

10.2. Dispute Resolution

In the event of disputes arising from the use of the Service, the parties undertake to seek an amicable solution. If an amicable solution is not possible, the dispute will be resolved by the court having jurisdiction over the Provider's registered office.

10.3. Information for Consumers

A User who is a consumer may use out-of-court complaint and redress procedures, in particular by submitting a complaint to the Trade Inspection or using the ODR platform available at: http://ec.europa.eu/consumers/odr/.

10.4. Partial Invalidity

If any provision of these Terms of Service is found to be invalid or ineffective, the remaining provisions shall remain in force to the fullest extent permitted by law.
